Terms of Service
These Terms govern your use of InOutlet Excellence — the web consoles at
app.fcmgtech.com and admin.fcmgtech.com, the InOutlet mobile
app for iOS and Android, and the API at api.fcmgtech.com (together, the "Service"),
provided by FCMG Tech ("FCMG Tech", "we", "us").
1. Accepting these Terms
By signing in to the Service or installing and using the InOutlet app, you agree to these Terms. If you use the Service on behalf of a company, you confirm you are authorised to do so, and "you" includes that company. If you do not agree, do not use the Service.
2. Accounts and access
- Accounts are issued by the company that licenses the Service ("Customer") — typically your employer. You cannot self-register in the app.
- Your credentials are personal. Do not share them, and do not let anyone else use your account.
- You are responsible for everything done through your account. Tell your administrator and privacy@fcmgtech.com immediately if you suspect it has been compromised.
- Keep your password confidential and use a strong one (minimum eight characters, enforced by the Service).
3. Your employer's role
The Customer controls its tenant on the Service: who has an account, what role and permissions each user has, which outlets, routes and clients are assigned, what tasks must be completed, and how long records are kept. The Customer can view, export, correct and delete the work recorded under its tenant, including your visits, photos, orders and the location points captured with them. Your use of the Service is also subject to your employer's own policies.
4. Licence to use the app
Subject to these Terms and the Customer's active subscription, FCMG Tech grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the InOutlet app on a device you own or control, solely for the Customer's internal business purposes. All rights not expressly granted are reserved.
5. Acceptable use
You agree not to:
- falsify field data — including spoofing your device location, submitting photos that do not show the outlet visited, or recording a visit you did not make;
- access data belonging to another tenant, user or client, or attempt to bypass the Service's authentication, authorisation or tenant-isolation controls;
- probe, scan, overload or interfere with the Service, its rate limits or its infrastructure;
- reverse engineer, decompile, modify or create derivative works of the Service, except where such restriction is prohibited by law;
- scrape or bulk-export data other than through features and APIs we provide;
- upload malware, or content that is unlawful, infringing or offensive;
- resell, sublicense or provide the Service to a third party.
Violations may lead to immediate suspension of your account and, where appropriate, notification of your employer and the authorities.
6. Location, camera and notifications
The app records your device location at specific moments during an active visit or route run — check-in, check-out, completed tasks, photos, route stops and supervisor check requests — so that your employer can verify where and when the work happened. It does not track you continuously and does not record your location outside those moments. The camera is used to photograph shelves and displays and to scan barcodes; push notifications are used for route reminders, alerts and supervisor requests.
These permissions are granted by you through your device's operating system and can be withdrawn there at any time. If you withdraw them, parts of the Service — notably check-in verification, photo tasks and notifications — will stop working, and your employer may treat the affected work as incomplete. See the Privacy Policy for detail.
7. Customer data and privacy
Data entered into the Service belongs to the Customer. FCMG Tech processes it on the Customer's instructions to provide, secure and support the Service, and in accordance with the Privacy Policy, which forms part of these Terms. We may use aggregated, de-identified statistics that identify neither you nor any Customer to operate and improve the Service.
8. Intellectual property
The Service, including its software, design, documentation and the InOutlet and FCMG Tech names and logos, is owned by FCMG Tech and protected by intellectual-property laws. These Terms grant a licence to use the Service, not a sale of any rights in it. Feedback you send us may be used without obligation or compensation.
9. Third-party services
The Service relies on third parties — including Apple and Google for app distribution and push notifications, Apple Maps and Google Maps for map display, and our hosting providers — and may connect to systems your employer chooses to integrate, such as an ERP. Those services have their own terms, and we are not responsible for their availability or acts.
10. Fees and subscriptions
The Service is sold to Customers under a separate written agreement or subscription plan. There are no in-app purchases and the app collects no payment information from individual users. Plan entitlements — such as user limits and feature availability — are enforced by the Service, and features outside the Customer's plan may be unavailable or restricted.
11. Availability and support
We aim to keep the Service available and to give reasonable notice of planned maintenance, but we do not guarantee uninterrupted operation unless a separate service-level agreement with the Customer says otherwise. The app is designed to work offline and to sync queued work when connectivity returns; sync depends on your device and network. Support is provided to the Customer's nominated contacts through the channels agreed with them.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free, secure or uninterrupted. Location accuracy depends on your device and its environment and may vary; we do not warrant that any location reading, map position or distance calculation is exact.
13. Limitation of liability
To the maximum extent permitted by law, FCMG Tech will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, arising out of or related to the Service. Our total aggregate liability arising out of or related to the Service is limited to the amounts paid to FCMG Tech by the relevant Customer for the Service in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
14. Indemnity
You agree to indemnify and hold FCMG Tech harmless from claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
15. Suspension and termination
The Customer may deactivate your account at any time. We may suspend or terminate access — with notice where practicable — if these Terms are breached, if the Customer's subscription ends or is unpaid, or if continued access poses a security or legal risk. On termination, your right to use the Service ends; the Customer's data is handled as described in the Privacy Policy. Sections 7, 8 and 12–18 survive termination.
16. Apple App Store terms
For the InOutlet app downloaded from the Apple App Store, the following also applies:
- These Terms are between you and FCMG Tech only, not with Apple. FCMG Tech, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to use on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Use.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- FCMG Tech, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, and consumer protection claims.
- FCMG Tech, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party intellectual-property infringement claim relating to the app.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government prohibited-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
17. Changes to the Service and these Terms
We develop the Service continuously and may add, change or remove features. We may update these Terms; the "Last updated" date above reflects the current version, and material changes will be communicated to Customer administrators. Continuing to use the Service after an update means you accept the revised Terms.
18. Governing law
These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law rules. The courts of the State of Qatar have exclusive jurisdiction over any dispute arising out of or in connection with them, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information. If any provision is held unenforceable, the rest remains in effect.
